Yea, it seems to be a normal way of doing business in the only country
in the world with software patents.  No one really knows who is
infringing on whom, so it becomes a I won't sue you if you won't sue me
deal. 

Based on what I am reading, the Supreme Court seems to be pointing the
way to the end of software patents so it may be a non issue in 5-10
years.   But now. 

M$ has paid some big court imposed dollars on this very issue, so it is
no surprise that it is trying to protect itself.
